| ○ A person who has applied for the status of residence in accordance with Article 23 of the law for being born in the Republic of Korea and whose father or mother is in the Republic of Korea as a permanent resident (F-5) at the time of birth, recognized by the Minister of Justice |

| ○ At least one of the father or mother must be staying in Korea with permanent resident (F-5) status; a parent without F-5 must be staying legally under a long-term status other than E-8, E-9, E-10, H-1 or G-1. The applicant must be born in Korea (children born overseas are not eligible) and the parents must be legally married and live together with the applicant as a family |
| ○ The application must be filed within 1 year of the child's birth (applications after 1 year cannot be made, and applying more than 90 days after birth is subject to a fine) |
