1. Overview
Immigration violation review is an administrative process for foreigners who violated immigration law. Depending on the case, consequences such as a fine (beomchik-geum), a departure order, a deportation order or an entry ban may follow, and these can affect later status applications. Whether any response or relief is possible is decided by the authorities case by case, so please confirm with the competent Immigration Office.
2. Eligibility Requirements
- Immigration violations are checked in later applications: for F-5 permanent residence, three or more violations of the Immigration Control Act in the last five years (administrative fines excluded) is a disqualifying ground
- For F-5, a fine (beomchik-geum) of 5 million won or more in the last three years, or combined fines of 7 million won or more, is also a disqualifying ground
- For F-5, five years must pass after leaving under a departure order (seven years for a deportation order)
- For F-2-7 points, immigration-law violations lead to point deductions
- The treatment of an individual violation depends on the case and is decided by the Immigration Office
3. Required Documents
Documents differ by case; please confirm with the competent Immigration Office.
4. Procedure
